⚠ Critical Legal Update — 2025

Washington State ESHB 2532, signed into law in 2025, makes it a gross misdemeanor to sell, distribute, or provide nitrous oxide outside of specifically exempted purposes. This law took effect approximately June 9, 2025 (90 days after passage on March 11, 2025).

Shaolin Cream sells culinary-grade N2O chargers exclusively for their lawful purpose as a food propellant (whipped cream, culinary foams, espumas). Any other use falls outside the scope of our products and may violate state law.

What Is Nitrous Oxide (N₂O) and How Is It Used in Cream Chargers?

Nitrous oxide is a colorless, non-flammable gas with a slightly sweet odor commonly used in food-grade cream chargers. It has a long and legitimate history across multiple professional fields. In culinary applications, N₂O cream chargers are used to pressurize whipped cream dispensers and create culinary foams, mousses, and flavor infusions. In medical and dental settings, it serves as an analgesic. Industrially, it is used in automotive performance and manufacturing processes.

Despite its legitimate uses, nitrous oxide has also been misused as an inhalant for its brief intoxicating effects — a practice that is dangerous, illegal, and the primary reason Washington state enacted new restrictions in 2025.

02 — Washington State Law

Governing Laws & Statutes

ESHB 2532 — Retail Sale Restrictions (2025)

The most significant recent change to Washington law is Engrossed Substitute House Bill 2532, which broadly restricts the retail sale and distribution of nitrous oxide throughout the state. Washington joined Louisiana as one of the only states in the nation to enact such restrictions.

It is unlawful to sell, furnish, distribute, or give away nitrous oxide outside of specifically enumerated exempt purposes. Violation constitutes a gross misdemeanor.

Penalty: Gross Misdemeanor — up to 364 days in jail and/or up to $5,000 fine (RCW 9A.20.021)

RCW 9.47A — Inhaling Toxic Fumes

Washington's Inhaling Toxic Fumes chapter has been on the books for decades and makes it illegal to intentionally inhale any substance — including nitrous oxide — for the purpose of intoxication, euphoria, or sensory impairment.

RCW 9.47A.020 — Unlawful Inhalation

It is unlawful for any person to intentionally smell or inhale the fumes of any substance for the purpose of causing intoxication, elation, euphoria, dizziness, excitement, irrational behavior, exhilaration, paralysis, stupefaction, or dulling of the senses of the nervous system. This section does not apply to the inhalation of any anesthesia for medical or dental purposes.

Lawful & Exempted Uses Under Washington Law

ESHB 2532 does not ban all use of nitrous oxide — it targets non-exempt retail distribution. The following uses are explicitly permitted under the statute:

04 — Safe Culinary Use

Safe Handling & Culinary Best Practices

When used correctly for culinary purposes, N2O chargers are a safe and effective kitchen tool. Follow these guidelines every time.

Temperature & Storage

Store chargers in a cool, dry place away from direct sunlight and heat sources. Never exceed 50°C (122°F). High heat can cause pressurized cartridges to rupture.

Handling Chargers

Do not shake, drop, or puncture chargers outside of a compatible dispenser. Always use chargers with a properly rated whipped cream dispenser or iSi siphon. Never attempt to open a charged container forcefully.

Keep Away from Children

N2O chargers are not toys. Store out of reach of minors. We do not sell to anyone under 21 years of age. Age and identity verification is required at checkout, and adult signature (21+) is required on delivery for every shipment.

Never Inhale Directly

Do not discharge a charger directly toward your face or body. Gas exiting a cartridge is extremely cold (cryogenic burns) and displaces oxygen. Direct inhalation causes hypoxia and can result in loss of consciousness or death.

Use Correct Equipment

Only use N2O chargers with dispensers specifically designed for N2O. Never use CO₂ chargers in an N2O dispenser or vice versa. Inspect dispenser seals and gaskets before each use.

Proper Disposal

Spent chargers must be fully empty before disposal. Do not place pressurized chargers in regular trash or recycling. Check your local municipal recycling program — many accept empty steel cartridges as scrap metal.
